These Terms and Conditions (“Terms”) govern your access to and use of the OnSet website, platform, tools, automations, software, content, services, and related products (together, the “Service”).
By using the Service, creating an account, booking a call, purchasing a plan, or accessing our website, you agree to these Terms. If you do not agree, you must not use the Service.
1. Who We Are
The Service is operated by OnSet.

In these Terms, “OnSet”, “we”, “us”, and “our” means the business operating the Service. “You” and “Customer” means the person or business using the Service.
2. What OnSet Does
OnSet provides automation tools designed to help business owners, offer owners, agencies, coaches, consultants, and service providers automate parts of their lead handling, appointment setting, follow-up, outreach, qualification, and booking workflows.
The Service may include automated messaging, lead capture, CRM workflows, integrations, scripts, templates, artificial intelligence features, analytics, and other automation tools.
OnSet does not guarantee that the Service will replace all human work, generate specific revenue, book a specific number of calls, or produce any guaranteed business outcome.
3. Eligibility
You must be at least 18 years old and able to enter into a legally binding agreement to use the Service.
If you use the Service on behalf of a business, you confirm that you have authority to bind that business to these Terms.
4. Accounts
You are responsible for keeping your login details secure.
You are responsible for all activity under your account, including activity by your employees, contractors, team members, or anyone else you allow to access the Service.
You must notify us immediately if you believe your account has been accessed without permission.
5. Ownership of OnSet Property
OnSet owns all rights, title, and interest in and to the Service, including the website, platform, software, code, systems, workflows, automations, designs, layouts, dashboards, documentation, templates, scripts, copy frameworks, brand assets, logos, trade names, processes, methods, analytics, improvements, and other intellectual property created by or for OnSet.
You do not receive ownership of the Service or any OnSet intellectual property.
You may not copy, reproduce, resell, reverse engineer, modify, distribute, scrape, clone, decompile, imitate, or create competing products from the Service or any OnSet materials unless we give you written permission.
6. Customer Content and Customer Data
You keep ownership of the materials, business information, offers, lead lists, customer information, messages, prompts, files, campaigns, and other content you upload or provide to the Service (“Customer Content”).
By submitting Customer Content to the Service, you grant OnSet a worldwide, non-exclusive, royalty-free licence to use, host, store, copy, process, transmit, display, modify, and analyse that Customer Content only as needed to provide, maintain, secure, improve, and support the Service.
You are responsible for ensuring that you have the legal right to upload, use, contact, process, and share any Customer Content or lead data through the Service.
7. Outputs and Campaign Materials
Subject to your payment of all applicable fees, you may use outputs generated for you by the Service, such as messages, scripts, workflows, campaign copy, lead responses, and booking flows, for your own business purposes.
OnSet retains ownership of the underlying platform, software, systems, templates, models, automation logic, workflow structure, know-how, and intellectual property used to generate those outputs.
You are responsible for reviewing all outputs before using them. You must ensure that any automated messages, claims, offers, guarantees, pricing, promises, and representations are accurate, lawful, and not misleading.
8. Acceptable Use
You must not use the Service to:
- send spam, unlawful marketing, deceptive messages, phishing messages, or fraudulent communications;
- contact people without the required permissions, lawful basis, consent, or legal right;
- violate privacy, data protection, consumer protection, advertising, marketing, or anti-spam laws;
- make false, misleading, or exaggerated claims about your offer, income potential, results, qualifications, or guarantees;
- harass, abuse, threaten, discriminate against, or exploit anyone;
- upload malware, spyware, viruses, or harmful code;
- interfere with the security, availability, or performance of the Service;
- scrape, copy, or extract data from the Service without permission;
- use the Service to build, train, or improve a competing product;
- use the Service for illegal, harmful, or high-risk activities.
We may suspend or terminate your access if we believe you have violated these Terms.
9. Marketing, Outreach, and Compliance
You are responsible for complying with all laws that apply to your marketing, sales, outreach, follow-up, appointment setting, and lead generation activities.
This includes, where applicable, rules relating to email marketing, SMS marketing, direct messages, cold outreach, cookies, consent, unsubscribe requests, do-not-contact lists, consumer protection, advertising standards, privacy, and data protection.
You must provide accurate sender information, honour opt-out and unsubscribe requests, and avoid misleading subject lines, identities, claims, or offers.
OnSet provides tools. You remain responsible for how you use those tools.
10. Third-Party Services and Integrations
The Service may integrate with third-party platforms, including CRM systems, calendars, messaging tools, payment processors, analytics tools, AI providers, email platforms, and social platforms.
Your use of third-party services may be governed by their own terms and privacy policies.
OnSet is not responsible for third-party services, outages, pricing changes, data handling, account restrictions, or platform decisions.
11. Fees and Payment
You agree to pay all fees shown at checkout, in your order form, or in a separate written agreement.
Fees may be charged as one-time payments, subscriptions, usage-based charges, setup fees, or other payment structures.
Unless otherwise stated in writing, fees are non-refundable.
You authorise OnSet and its payment providers to charge your selected payment method for all applicable fees, taxes, renewals, and charges.
If payment fails, we may suspend or terminate your access to the Service.
12. Trials, Subscriptions, and Cancellations
If we offer a free trial, discounted trial, or promotional period, the terms of that offer will apply.
Subscriptions renew automatically unless cancelled before the renewal date.
You are responsible for cancelling your subscription through the method we provide or by contacting us at INSERT SUPPORT EMAIL.
Cancellation stops future renewal charges but does not automatically entitle you to a refund for past charges.
13. No Guaranteed Results
OnSet may help improve your systems, speed, follow-up, and appointment-setting process, but we do not guarantee sales, revenue, booked calls, conversion rates, profits, lead quality, business growth, or any specific result.
Your results depend on many factors outside our control, including your offer, pricing, market, targeting, audience, sales process, traffic quality, compliance, reputation, and follow-up.
14. AI and Automation Disclaimer
The Service may use automation, artificial intelligence, machine learning, or rule-based systems.
Automated outputs may be incomplete, inaccurate, inappropriate, outdated, or unsuitable for your specific use case.
You are responsible for reviewing, testing, approving, and monitoring all automated workflows, messages, and outputs before and after using them.
You must not rely on the Service as a substitute for legal, financial, compliance, tax, accounting, medical, or professional advice.
15. Confidentiality
Each party may receive confidential information from the other.
Confidential information includes non-public business information, technical information, pricing, strategy, customer data, software, processes, documents, and other information that should reasonably be understood as confidential.
Each party agrees to protect the other party’s confidential information and not disclose it except as needed to perform under these Terms, comply with law, or enforce legal rights.
16. Data Protection
Our collection and use of personal data is described in our Privacy Policy.
If we process personal data on behalf of a business customer, additional data protection terms or a Data Processing Agreement may apply.
You are responsible for ensuring that your use of the Service complies with applicable privacy and data protection laws.
17. Service Availability
We aim to keep the Service available and working, but we do not guarantee uninterrupted, error-free, or secure access.
The Service may be unavailable due to maintenance, upgrades, outages, third-party failures, security issues, or events outside our control.
We may modify, suspend, or discontinue parts of the Service at any time.
18. Beta Features
We may offer beta, test, experimental, or early-access features.
Beta features are provided “as is” and may be changed, removed, or discontinued at any time.
19. Restrictions on Resale
You may not sell, license, sublicense, rent, lease, distribute, white-label, or commercially exploit the Service unless we give you written permission.
20. Feedback
If you give us feedback, suggestions, ideas, or recommendations about the Service, you grant OnSet the right to use them without restriction or compensation.
We may use feedback to improve, modify, market, or develop the Service.
21. Termination
We may suspend or terminate your access to the Service if:
- you breach these Terms;
- you fail to pay fees when due;
- your use creates legal, security, reputational, or operational risk;
- we are required to do so by law or a third-party platform;
- we discontinue the Service.
You may stop using the Service at any time.
Termination does not affect any rights or obligations that should reasonably continue, including payment obligations, ownership rights, confidentiality, disclaimers, and limits of liability.
22. Disclaimer of Warranties
The Service is provided on an “as is” and “as available” basis.
To the maximum extent permitted by law, OnSet disclaims all warranties, whether express, implied, statutory, or otherwise, including warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, availability, and reliability.
23. Limitation of Liability
To the maximum extent permitted by law, OnSet will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, including lost profits, lost revenue, lost data, business interruption, loss of goodwill, or lost opportunities.
To the maximum extent permitted by law, OnSet’s total liability for any claim relating to the Service or these Terms will not exceed the amount you paid to OnSet in the three months before the event giving rise to the claim.
Nothing in these Terms limits liability that cannot legally be limited.
24. Indemnity
You agree to indemnify and hold harmless OnSet, its owners, directors, employees, contractors, partners, and affiliates from any claims, damages, losses, liabilities, costs, and expenses arising from:
- your use of the Service;
- your Customer Content;
- your marketing, outreach, sales, or appointment-setting activity;
- your breach of these Terms;
- your violation of law;
- your infringement of someone else’s rights.
25. Changes to These Terms
We may update these Terms from time to time.
The updated version will be posted on our website with a new “Last updated” date.
Your continued use of the Service after changes become effective means you accept the updated Terms.
26. Governing Law
These Terms are governed by the laws of INSERT COUNTRY / STATE / JURISDICTION.
The courts of INSERT COURTS / LOCATION will have exclusive jurisdiction, unless applicable law requires otherwise.
